Welcome to MemoWear. These Terms of Service (“Terms”) govern your access to and use of the MemoWear website and your purchase of products from us.

By accessing our website or placing an order, you agree to these Terms. If you do not agree with these terms, please do not use our website or place an order.

1. About MemoWear

MemoWear is a personalised apparel brand offering customised and made-to-order products.

Our products may include personalised designs based on information, photographs, initials, dates, text, or other details provided by customers.

2. Eligibility

By using our website or placing an order, you confirm that:

  • You are legally capable of entering into a binding agreement.

  • The information you provide is accurate and complete.

  • You have the necessary rights or permission to use any photographs, images, names, logos, artwork, or other content you submit for customisation.

3. Products and Product Information

We make reasonable efforts to display our products, colours, designs, sizes, and other product information as accurately as possible.

However, actual colours may vary slightly depending on your device screen, lighting, photography, printing process, or other factors.

Personalised products may also have minor variations in print placement, colour, or appearance that do not materially affect the product.

4. Personalised Orders

Because MemoWear products may be customised and made specifically for you, you are responsible for carefully checking all information submitted during the order process, including:

  • Photos

  • Names

  • Initials

  • Dates

  • Custom text

  • Design instructions

  • Size

  • Quantity

MemoWear is not responsible for errors resulting from incorrect information supplied by the customer.

Where we provide a design preview for approval, you are responsible for reviewing the preview carefully before approving it for production.

Once a personalised order has entered production, changes or cancellations may no longer be possible.

5. Customer-Submitted Content

By submitting photographs, images, text, names, initials, or other content for personalisation, you confirm that:

  • You own the content or have permission to use it.

  • Your submission does not knowingly violate another person's intellectual property, privacy, publicity, or other legal rights.

  • The content does not contain unlawful or prohibited material.

You grant MemoWear and its production partners a limited right to use the submitted content solely as reasonably necessary to create, process, print, fulfil, and deliver your order.

We do not claim ownership of your personal photographs or other customer-submitted content.

6. Right to Refuse an Order

MemoWear reserves the right to refuse or cancel an order where the submitted content or requested customisation:

  • Appears to violate applicable law

  • Infringes another person's intellectual property or other rights

  • Contains unlawful or prohibited material

  • Cannot reasonably be produced

  • Contains fraudulent or misleading information

  • Creates an unreasonable operational or legal risk

If we cancel an order for a reason attributable to MemoWear, any applicable payment will be refunded.

7. Pricing

All product prices displayed on our website are subject to change without prior notice.

The applicable price for an order is generally the price displayed at the time the order is placed, subject to any obvious pricing error or applicable legal requirements.

Shipping charges, taxes, discounts, or other applicable charges will be displayed during the purchase process where applicable.

8. Orders and Payment

An order is considered successfully placed only after the order has been accepted by MemoWear and, where applicable, payment has been successfully received or the selected payment method has been authorised.

We reserve the right to cancel or limit an order where necessary due to:

  • Product availability

  • Pricing or listing errors

  • Payment issues

  • Suspected fraud

  • Incorrect customer information

  • Production limitations

If an order is cancelled after payment has been received, any applicable refund will be processed according to our Refund Policy.

9. Shipping and Delivery

We aim to process and dispatch orders within the estimated timeframe communicated on the website or during checkout.

Delivery times may vary depending on the destination, courier service, weather, holidays, operational delays, or circumstances beyond our reasonable control.

Once an order has been handed over to the shipping provider, delays caused by the carrier may be outside MemoWear's direct control.

Customers are responsible for providing an accurate and complete shipping address and contact information.

10. Returns, Replacements and Refunds

Personalised and made-to-order products are generally not eligible for return solely because of a change of mind, incorrect size selection, or incorrect customisation information supplied by the customer.

However, if you receive a product that is damaged, defective, incorrect, or materially different from what you ordered, you may be eligible for a replacement or refund.

11. Intellectual Property

All content on the MemoWear website, including but not limited to:

  • Logos

  • Brand names

  • Product designs

  • Graphics

  • Photographs

  • Website content

  • Text

  • Layouts

  • Videos

  • Other original materials

may be owned by or licensed to MemoWear and may be protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, publish, or commercially exploit our content without prior written permission, except where permitted by applicable law.
